How to Get Out of a Westgate Timeshare: The Legacy Program and What 'Qualifying Accounts' Means

Westgate's Legacy Program promises exit options for 'qualifying accounts' without saying publicly who qualifies. Here is what Westgate publishes, what a court reportedly said about its rules, how to check resale value, and when a free file review makes sense after a no.

How do I get out of my Westgate timeshare?

If you are still inside your state’s cancellation window, cancel in writing now, because that is free and returns your money. Otherwise, call The Legacy Program by Westgate at 800-351-0461, Monday to Friday, 9 a.m. to 5 p.m. ET, and check what your ownership would actually sell for. Ask the Legacy Program whether any condition about exit companies applies before you contact one. According to Rebecca Tushnet’s law blog, an exit company alleged, in a lawsuit decided in 2024, that Westgate has conditioned repossessions on an affidavit that the owner has not worked with “any timeshare exit company, lawyer or law firm”; Westgate disputes that the language covers all lawyers. The Legacy Program is Westgate’s in-house exit program, and Westgate says its goal is “to provide safe and secure exit options for all qualifying accounts,” including returning the ownership to the developer. Westgate does not publish what makes an account qualify, what the program costs, or how long it takes. Its contact form asks whether you have an open mortgage, so expect the loan to matter. If the timeshare has no resale value and Westgate turns you down or quotes terms you can’t accept, a free consultation and file review from an attorney-backed exit firm is one route to consider.

Who is Westgate?

Westgate Resorts is a private company. It says it was “Founded by David Siegel in 1982,” began as Central Florida Investments, Inc., and has grown into “the largest privately-held corporation in Central Florida,” with “more than 60 resort properties.” Its newest product is VI Resorts by Westgate, which it describes as “the newest points-based vacation club in the company’s portfolio.”

Because Westgate is private, it files no annual report with the SEC. There is no public figure for its owner count, its loan rates, its default rate, or how much of its business comes from existing owners. Some Westgate buyers hold what lawsuits describe as a “floating use” plan, so check your contract to see whether you own a fixed week, a floating week, or points.

What is The Legacy Program by Westgate?

Westgate’s page says: “The Legacy Program by Westgate has been created to assist owners in understanding available options for transitioning away from vacation ownership. It is our goal to provide safe and secure exit options for all qualifying accounts.” It calls the program “the ONLY Developer-guaranteed release option.” The options it lists are “returning your ownership to the Developer, understanding the resale market, or transitioning your ownership to a family member, friend or acquaintance.” It says owners who relinquished their timeshare “have been able to do so with very little effort” and were relieved of future maintenance fees. Westgate’s listing on responsibleexit.com, the exit directory run by ARDA, the developers’ trade group, adds that the program is “not affiliated with any third-party companies.”

Cost: not published.

Who it works for: “qualifying accounts.” Westgate does not define the term publicly.

What disqualifies you: not published. The contact form asks “Do you have an open mortgage?” which suggests the loan is part of the review.

What does “qualifying accounts” mean at Westgate?

The clearest description we found comes from a court case Westgate won against an exit company. In Wesley Financial Group v. Westgate Resorts, No. 6:23-cv-2347 in the federal court for the Middle District of Florida, the court ruled on August 28, 2024. We could not open the order itself. A post on Rebecca Tushnet’s law blog summarizes the order and says Westgate “will not repossess financed timeshare interests with outstanding loan balances if owners are current on their payments.” The post, summarizing the order, quotes this description of Westgate’s policy: “Only paid-off (or inherited) timeshares qualify for voluntary repossession or termination with Westgate, and only at its discretion.”

According to the same post, the court reasoned that “qualified owners” does not mean or imply “most owners,” and found Westgate’s Legacy Program advertising not likely to be materially misleading. The post quotes the order’s description of the program as “undisputedly the only developer-backed way to cancel a Westgate timeshare,” and its finding that advertising it “does not injure consumers substantially, even if the ads lead consumers to phone trees or high-pressure sales pitches before learning Westgate will not let them out.” Wesley, an exit company, lost.

So the court rejected the claim that Westgate’s advertising misled owners, for a program that, as the order reportedly describes it, is limited to paid-off or inherited timeshares and runs at Westgate’s discretion. If the order’s description still holds, owners with a balance should expect a no. Ask anyway, ask in writing, and keep the answer.

Why call the Legacy Program before an exit firm?

The FTC tells owners exploring an exit to “start by contacting your timeshare company directly,” and with Westgate the timing carries an extra reason. According to Rebecca Tushnet’s law blog, an exit company alleged, in a lawsuit decided in 2024, that Westgate has conditioned repossessions on an affidavit that the owner has not worked with “any timeshare exit company, lawyer or law firm.” Westgate disputes that the language covers all lawyers, and the court called it “sweeping.” Ask the Legacy Program whether any such condition applies before you contact an exit firm, and get the answer in writing.

Use the same call to check the resale market, which the Legacy Program lists as one of its options. Ask what similar Westgate ownerships have actually sold for, not what they are listed at. If you do list, the FTC says to deal only with licensed agents and brokers and to check with the real estate licensing agency in the state where the timeshare is located.

How much does the Westgate loan cost you?

Westgate does not publish its loan rates, so check the annual percentage rate on your own contract. For comparison, three publicly traded developers reported weighted average rates on their timeshare loans for 2025 of 12.9% at Marriott Vacations Worldwide, 14.6% at Travel + Leisure (Wyndham), and 14.7% at Hilton Grand Vacations.

Few lenders will refinance against the timeshare itself, because it has almost no resale value. If you qualify for a lower rate, a personal loan can replace the developer’s loan. If the Legacy Program is limited to paid-off timeshares, a payoff may be what opens it, but get Westgate’s written answer on whether you would qualify once the balance is zero before you refinance to get there. The ownership and the loan are separate obligations; our loan payoff guide shows how to price both.

Why does Westgate keep pushing upgrades?

Westgate publishes no sales figures. Industry-wide, ARDA’s industry-commissioned 2026 study found that 61% of 2025 timeshare sales volume went to people who already owned one.

Westgate owners have made specific allegations about how that selling works. A 2018 class action complaint filed against Westgate in Tennessee alleges that Westgate assigns owners a “concierge” who “is a sales person who pressures owners to ‘upgrade’ their prior purchase,” and that Westgate represents an annual “owners’ meeting” as mandatory when it is “an all-day, one-on-one sales meeting.” These are allegations in a complaint, and we could not confirm how the case ended. Either way, a call to the Legacy Program or an owner meeting can turn into an upgrade offer. Don’t sign anything at that call or meeting; an upgrade is a bigger contract with bigger fees, and if it is the answer you get to a request to leave, treat it as a no. See the upgrade trap.

What have Westgate owners alleged in court?

Two class actions make allegations about how Westgate closes a sale. Both are allegations only, and nothing below is a finding against Westgate.

Moore v. Westgate Resorts, Ltd. Filed September 25, 2018, in federal court in the Eastern District of Tennessee (No. 3:18-cv-00410), on behalf of buyers at Westgate Smoky Mountain Resort in Gatlinburg. The complaint alleges that Westgate gives closing agents a closing folio “that contains a ‘secret pocket’ where the closing officers can conceal legally required disclosures about the purchasers’ rights, including their statutory right to rescind their purchase.” It also alleges Westgate fails to adequately disclose that the purchase is subject to a “floating use” plan. We could not confirm the outcome.

Hambacker v. Westgate Resorts, Ltd. Filed June 23, 2020, in federal court in the Eastern District of Missouri (No. 4:20-cv-00833), covering buyers at Westgate resorts in Branson and Hollister, Missouri; Gatlinburg; Las Vegas; Myrtle Beach; and Orlando. It makes the same “secret pocket” allegation. We could not confirm the outcome.

The practical lesson is the rescission one. If you are still inside your cancellation window, empty every pocket of your closing folder and look for the cancellation notice and the deadline.

Can I still cancel with rescission?

If you are still inside your state’s cancellation window, yes, and it is the only route here that returns your money. Nolo puts the usual window at 3 to 15 days, varying by state, and notes the right is typically nonwaivable. Find the cancellation notice in your closing folder, send it by the method it names, and keep proof of delivery. Our rescission deadline tool and state-by-state guide give your date.

What if Westgate says no?

Get the refusal in writing and ask exactly what disqualified you. If it was the loan, the loan section above applies. If you were pointed to the resale market, you keep the ownership and its fees until a buyer closes.

Vacation Ownership Consultants (VOC), an attorney-backed exit firm in Scottsdale, Arizona, quotes Westgate’s own description of the Legacy Program in its guide to developer surrender programs and advises owners to request written confirmation before assuming they have been released. That advice applies whether Westgate says yes or no. VOC’s own process begins with the same step this page does: “Contact your resort and check the resale market.”

With Westgate’s written answer in hand, no resale value, and a refusal or terms you can’t accept, a free consultation and file review is the step to consider next. VOC asks for your billing statements, purchase agreement, and deed, if you have one, through its eligibility form; it then determines what your ownership may qualify for and gives you a free file review, and you decide only after that whether to enroll for a one-time flat fee. VOC’s home page says it doesn’t “discuss billing until we’ve made sure you qualify.” VOC’s review is free; other firms set their own terms. A review can tell you which route fits your ownership and whether anything in your closing documents, or said at the sale, may support a claim.

An attorney-backed exit firm is one route to consider for owners Westgate turns away, especially those whose account doesn’t “qualify” because a loan balance remains. A legitimate firm reviews your contract and payment history before it quotes anything. Where the method calls for it, the firm retains an attorney who deals with Westgate on your behalf and looks for specific problems with how the timeshare was sold, such as a missing disclosure or a salesperson who pitched it as an investment. In our view, a lawyer’s letter is harder to ignore than a phone queue. No firm can promise how Westgate will respond.

Westgate has taken exit operators to court, and two rulings describe conduct a legitimate firm avoids:

  • In Westgate Resorts, Ltd. v. Sussman (M.D. Fla. No. 6:17-cv-1467), a federal court found in a May 31, 2019 order that the exit lawyer’s “directions that owners stop payments, made under the guise that doing so will rid them of their timeshares, are fraudulent and wrongful.”
  • In Westgate Resorts, Ltd. v. Wesley Financial Group, LLC (M.D. Tenn. No. 3:20-cv-00599), a federal court found on August 8, 2023 that “Wesley engaged, and apparently continues to engage, in the unauthorized practice of law.”

Regulators elsewhere have acted too. Washington’s attorney general said in 2020 that “Reed Hein does business under the name Timeshare Exit Team,” and its 2021 settlement release says more than 2,800 Washingtonians paid the company upfront fees from just under $3,000 to tens of thousands of dollars per exit. In April 2026, after an FTC investigation, a federal court ordered Christopher Carroll, a top operator of a timeshare exit scheme run through a company called Consumer Law Protection, to pay $140 million. With those cases in mind, a Westgate owner should confirm three things about any firm:

  • A licensed attorney, whom the firm names and you can look up with the state bar, does the legal work.
  • The firm never tells you to stop paying Westgate. The Sussman court called that advice fraudulent and wrongful, and the FTC lists it as a scam sign.
  • The firm asks whether you have applied to the Legacy Program, and whether any affidavit condition Westgate may apply could cost you that option, before you sign.

Our red flags page covers the rest, and our stop-paying guide explains what missed payments can lead to.

The order to work in

Still inside your cancellation window? Find the cancellation notice in your closing folder, check your rescission deadline, and cancel in writing today. It is free and returns your money.

Everyone else: start with the Legacy Program and the resale market. Use 800-351-0461 and ask in writing what makes an account qualify, whether yours does, what it costs, how long it takes, and whether any condition about exit companies applies. Find out what similar Westgate ownerships really sell for, and sign nothing if you are offered an upgrade.

Still owe on the loan? Ask whether a payoff would make you eligible, and compare a lower-rate personal loan before you refinance.

No resale value, and Westgate said no or quoted terms you can’t accept? Get a free consultation and file review from an attorney-backed exit firm that passes the checks above.

Other routes: ask about the transfer option the Legacy Program lists, moving the ownership to a family member, friend or acquaintance who wants it. If you have documents showing a missing disclosure or a false sales promise, your own attorney can review a claim. A resale through a licensed broker who takes fees only after the sale is another option. Run the exit cost calculator on what staying costs.

This is general information, not legal advice. Westgate sets its Legacy Program terms privately and can change them, and your options depend on your contract, your loan, and the law in your state. Before you sign a release, refinance to qualify for one, or stop any payment, put your contract in front of an attorney licensed in your state.

Frequently asked questions

Does Westgate have a timeshare exit program?

Yes. It is called The Legacy Program by Westgate, and Westgate says its goal is 'to provide safe and secure exit options for all qualifying accounts.' The options it lists are returning the ownership to the developer, understanding the resale market, or transferring it to a family member, friend, or acquaintance. Call 800-351-0461, Monday to Friday, 9 a.m. to 5 p.m. ET.

Who qualifies for Westgate's Legacy Program?

Westgate does not say publicly. Its page refers only to 'qualifying accounts,' and its contact form asks whether you have an open mortgage. Rebecca Tushnet's law blog, summarizing an August 2024 federal court order, quotes this description of Westgate's policy: 'Only paid-off (or inherited) timeshares qualify for voluntary repossession or termination with Westgate, and only at its discretion.' We could not open the order itself.

How much does the Westgate Legacy Program cost?

Westgate does not publish a fee or a processing time for the Legacy Program. Ask for both in writing before you agree to anything, along with the eligibility rules and a description of the document you will receive when the release is complete.

What interest rate does Westgate charge on timeshare loans?

Westgate is a private company and does not publish loan rates, so check the rate on your own contract. For comparison, three publicly traded developers reported weighted average rates of 12.9% to 14.7% on their timeshare loans for 2025. If you qualify for a lower rate, a personal loan can replace the developer's loan.

What happens if an exit company tells me to stop paying Westgate?

End the conversation. In a 2019 order in Westgate's lawsuit against exit lawyer Mitchell Sussman, a federal court found that his directions that owners stop paying, made under the guise that doing so would rid them of their timeshares, were fraudulent and wrongful. The FTC also lists instructions to stop paying as a sign of an exit scam.

Should I call Westgate before contacting an exit firm?

Yes. Start with the Legacy Program and check what similar Westgate weeks or points actually sell for. According to Rebecca Tushnet's law blog, an exit company alleged, in a lawsuit decided in 2024, that Westgate has conditioned repossessions on an affidavit that the owner has not worked with 'any timeshare exit company, lawyer or law firm.' Westgate disputes that the language covers all lawyers, and the court called it 'sweeping.' Ask the Legacy Program whether any such condition applies before you contact an exit firm. If there is no resale value and Westgate refuses, a free consultation and file review from an attorney-backed exit firm is the next step to consider.

Start your timeshare exit with a free review.

If the resort won't take it back, an exit specialist will look at your contract and tell you whether you qualify. The consultation costs nothing, and you decide what happens next.
